The new blog post of Danaja Fabcic Povse "So long and see you in the next pandemic? The Court’s one-and-done approach on permissible reasons to restrict freedom of movement for public health reasons in the Nordic Info case (C-128/22) of 5 December 2023" is published in the European Law Blog.
In its decision Nordic Info (C-128/22), the CJEU gave Member States broad discretion to restrict movement in the name of fighting the covid-19 pandemic. It reaffirmed the important role of precautionary and proportionality principles, as well as the role of scientific evidence in supporting national public health measures, though it seems to treat the pandemic as a one-off event, which means that such arguments may not be accepted in future similar situations.
